International Committee of the Red Cross Accompanies Militant Group in Recovery for Bodies of Captives in Gaza Strip

The International Committee of the Red Cross (ICRC) stated that its representatives joined members of Hamas into areas of Gaza currently controlled by Israeli military control to support the search for the bodies of individuals held captive.

Truce Terms and Captive Remains Return

As part of the truce negotiated by the United States, which took effect on October 10, the group is required to hand over the bodies of all captives as soon as possible. In exchange, Israel has consented to transfer the remains of 15 Palestinians for each Israeli.

Hamas has to date handed back the remains of fifteen of those held captive but none in the last five days, as a portion of those remains are believed to be in areas beyond the yellow line marking Gaza’s ceasefire.

ICRC Involvement as Neutral Intermediary

“Upon the appeal of the involved sides, the International Committee of the Red Cross (ICRC) joined a participant in the hostilities as the party searched for the remains of the deceased past the military-established ‘yellow boundary’,” stated a spokesperson for the committee.

The spokesperson continued: “The parties to the hostilities established the procedures of the operation and delegated the ICRC to serve as a neutral intermediary. We was not involved in the discussions.”

She further clarified: “The ICRC was not involved in the search for the deceased nor does it engage in the retrieval of remains.”

Global Humanitarian Law and Responsibilities

According to global legal norms, it is the duty of the parties engaged in a hostilities to locate, gather, and recover human remains.

American Demand and Local Recovery Operations

On Saturday, the US president issued a two-day ultimatum to the organization. “Hamas is going to have to begin handing over the bodies of the hostages who died, which include American citizens, promptly, or the other countries participating in this great peace will intervene,” he wrote on his online channel.

When the 48-hour deadline neared, the group, accompanied by the ICRC, joined Egyptian teams, who were authorised by Israeli authorities to search for bodies past the line marking the withdrawal of troops inside Gaza. An official representative said the delegation would use excavator machines and trucks in the search.

Official Verification and Press Coverage

This development was corroborated by an unnamed Israeli official, who told Hebrew-language media that members of the group had been allowed to enter sections of the region under Israel Defense Forces (IDF) control to search for the bodies of captives, together with Egyptian and ICRC personnel.

“To achieve this goal, representatives were permitted to cross the yellow line,” the source was quoted as stating.

Footage published by a regional network seemed to show individuals of a specialized group – belonging to the organization’s military wing responsible for holding hostages – escorting a humanitarian transport in a specific location near Rafah, which is beyond IDF jurisdiction.

Difficulties in Locating Hostage Bodies

The search for the remains of Israeli hostages has become one of the most delicate matters in the ceasefire agreed between the parties. Yet, the attempt to find the bodies has been challenging from the outset, given the presence of an approximate 60m tonnes of rubble across the territory, where, as per health officials, at least ten thousand residents are listed as unaccounted for, trapped under the rubble.

Conflicting Statements on Remains Location

Hamas has stated it does not know the precise whereabouts of all the bodies, saying it has been unable to communicate with several of its units that had been holding the hostages and were reportedly eliminated during military strikes.

However, an official representative claimed that Hamas knew the locations of the remains. “Should the group exerted greater effort, they would be able to retrieve the bodies of our hostages,” the official said.

American Position and Weapons Surrender Talks

While the US president has conceded that some of the bodies are hard to reach, he said that “others they can return immediately and, for unknown reasons, they are failing to do so.”

“It may have to do with the surrender of weapons of the group,” he added.

The US administration has said it has received assurances from the organization that the group will surrender its arms, though no clear timeline has been established. The militant organisation remains hesitant to surrender its weapons without firm guarantees about the future of its fighters.
